Terms of Service

These Terms of Service ("Terms") govern your use of Lunart (the "Service"), available at lunart.app. The Service is operated by Paper Fox LLC, a New Mexico limited liability company ("we", "us"). By creating an account, subscribing or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

  1. Lunart is an online workspace for creating and editing images and videos with artificial intelligence. It includes AI image generation and editing (text-to-image, image editing with reference images, inpainting, outpainting, layer separation), AI video generation, an infinite canvas, a conversational creative assistant, an asset library, team workspaces and a public showcase.
  2. Generation is performed by third-party AI models that we integrate, such as GPT Image, Nano Banana, Seedance and MiniMax. Each model's capabilities, availability and credit price are shown in the Service and may change when a provider changes its offering.
  3. We may add, change, suspend or discontinue features. Where a change materially reduces what you paid for, we will give reasonable notice.

2. Eligibility and accounts

  1. You must be at least 18 years old, or the age of majority where you live, to use the Service. If you use the Service on behalf of a company, you confirm that you are authorised to accept these Terms for it.
  2. Provide accurate information when you sign up and keep it current. One person may not maintain multiple accounts to obtain free credits or rewards.
  3. Keep your password secure. You are responsible for activity under your account. If you believe your account has been compromised, change your password and contact us at [email protected].
  4. You can delete your account in account settings. Deletion takes effect after a cooling-off period shown on the page, during which you can cancel. After deletion, your projects, assets, generated content and remaining credits cannot be recovered.

3. Subscriptions, credits and payment

  1. Plans. The Service is offered as monthly or yearly subscriptions, priced in US dollars and paid through Stripe. We do not see or store your full card details. Prices exclude any taxes that apply where you live, which are added at checkout where required.
  2. Credits. Generations are billed in credits, which come with your plan. The credit cost of each generation is shown before you submit it.
  3. Renewal and cancellation. Your subscription renews automatically at the end of each billing month or year and is charged to your payment method on file until you cancel. You can cancel at any time from your account. Cancelling stops the next renewal; your plan stays active until the end of the time you have already paid for.
  4. Price changes. We will tell you before a new price applies to your subscription, and you can cancel before it takes effect.
  5. Refunds. You may request a refund of a subscription payment within 14 days of the charge if none of the credits it provided have been used. Used credits and free credits are not refundable. To request a refund, email [email protected] from your account email with your order number. Approved refunds are returned to the original payment method. Nothing in these Terms limits any refund right you have under the law of your place of residence.
  6. Chargebacks. If you dispute a charge with your bank instead of contacting us, we may suspend the account while the dispute is open.
  7. Credits have no cash value, cannot be transferred between accounts except through team features, and may not be resold.

4. Your content

  1. Your input. You are responsible for the prompts, images, videos and other material you upload ("Input"). You confirm that you own the Input or have the rights and permissions needed to use it, including the consent of any person whose likeness appears in it.
  2. Your output. As between you and us, you own the images and videos you generate ("Output"), subject to these Terms and to the terms of the AI provider used. You may use Output for personal and commercial purposes. Similar prompts can produce similar results for other users, so Output may not be unique.
  3. Licence to operate the Service. You grant us a limited licence to store, process, transmit and display your Input and Output only as needed to provide the Service to you, including sending it to the AI provider that performs your request. We do not use your content to train AI models.
  4. Showcase. If you submit a work to the public showcase, you allow us to display it and its prompt publicly within the Service. You can withdraw it at any time.
  5. AI labels. Generated images carry a visible "AI Generated" label or watermark and content-credential metadata. Do not remove them or present Output as real photography or human-made work in a way that misleads others.

5. Acceptable use

You may not use the Service to create, upload or share content that:

  1. sexualises minors in any way, or is sexually explicit content involving real, identifiable people;
  2. depicts a real person in a false or harmful way, including deepfakes used for fraud, harassment, defamation or political deception;
  3. infringes copyright, trademark, privacy, publicity or other rights of others;
  4. promotes terrorism or violent extremism, threatens or incites violence, or facilitates self-harm;
  5. supports fraud, scams, phishing, malware or other illegal activity.

You also may not: access the Service through bots, scrapers or unauthorised automation; circumvent rate limits, credit charges or safety filters; probe or attack our systems; or resell access to the Service without our written permission.

6. Content moderation

  1. Automated checks. Before an image is generated, its prompt is checked automatically against Section 5. A request that appears to break these rules is refused, and its credits are returned. The AI providers that perform generations also apply their own safety filters and may refuse a request or return no result.
  2. Human review. Works submitted to the public showcase are reviewed before they appear, and we may decline or remove any submission. We may also review content that is reported to us or flagged by our automated checks.
  3. Enforcement. If content or activity breaks these Terms, we may refuse requests, remove content, limit features, or suspend or close the account, depending on how serious the breach is and whether it is repeated. Where an account is closed for a serious breach, unused credits are not refunded. We report apparent child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) and cooperate with law enforcement as the law requires.
  4. Reports and appeals. To report content that breaks these Terms or infringes your rights, or to appeal a decision about your account or content, email [email protected] with links or details. We review every report and appeal and reply within a reasonable time.
  5. Limits. Automated checks are not perfect. A request may occasionally be refused by mistake, and passing a check does not mean that content is lawful or that you have the rights to use it. You remain responsible for your Input and for how you use Output.

7. Third-party services

The Service relies on third parties, including AI model providers, Cloudflare for content delivery, Backblaze for file storage, Stripe for payments and email delivery providers. Their availability is outside our control, and an outage on their side may make part of the Service temporarily unavailable.

8. Intellectual property

The Service, including its software, design, logos and the Lunart name, belongs to Paper Fox LLC or its licensors. These Terms do not give you any right to use them except to use the Service as intended.

9. Disclaimers

AI output can be inaccurate, unexpected or unsuitable for your purpose. The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. You are responsible for reviewing Output before you rely on or publish it.

10. Limitation of liability

To the fullest extent permitted by law, Paper Fox LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if required by law. Sections 3.5, 4, 7, 8, 9 and 12 survive termination.

12. Changes to these Terms

We may update these Terms. When we make a material change, we will post the new version in the Service and may ask you to accept it before continuing. Continuing to use the Service after a change takes effect means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Bernalillo County, New Mexico, and you and we consent to their jurisdiction. If you are a consumer living in a country whose law gives you the right to bring proceedings in your local courts, you keep that right.
